The inn also only lets white people in, whites only inn although this was illegal after apartheid had ended, he uses a pun here as in only whites allowed in, and it is a whites only, inn. In verse five the working mans cafi has a huge contrast to the restaurant, working mans cafi sells bunny chows bunny chow is a cheap African food, this is totally unlike the haute cuisine in the white restaurant, which is an upmarket food. He also has no plate to eat on, eat it at a plastic table top he does not have linen falls or a rose; there is a definite contrast between them. I think that there is a difference in between because the white have more money and privileges than the blacks; also if the blacks did have an inn like that they would not be able to afford it. The writer is trying to put across the point that it is unfair that they should have more than them, just because they are white. In the final verse he feels small, boy again he feels insignificant, and he knows he can not change anything. He feels the need to use violence to get his point across Hands burn for a stone, a bomb this could insinuate that he want to be able to be heard. He wants to break the glass, shiver down the glass the glass could be thought to be a barrier between blacks and whites, and he wants to break it down as if he were breaking down the wall of apartheid. The use of glass for the wall of apartheid could mean that it is fragile. The last line is nothings changed which is the first line, this could be interpreted as a circle, and that apartheid will never end.

I Like it Like That is a commentary on the struggles of a Latino family trying to survive in a Bronx community in New York City. It tells the story of Lisette Linares, a young black Latina who lives with her bicycle-messenger husband Chino and their three children Li'l C, Minnie, and Pee Wee in a perpetually cramped walkup on Findlay and 167th in the Bronx. The story begins with a bleak existence for our main character Lisette. Although the streets of the inner city constantly boil with activity and her husband leaves her wanting for nothing in the bedroom she is stifled and bored. Chino is the sole provider for the family and insists that his wife stay in her proper place at home with the children. The children are terrors and the oldest is experimenting with drug trafficking. Lisette feels helpless to change or rectify the situation. The struggles of this family are a direct response to the gender roles seen in Lisette and Chino. There are two questions in this film concerning gender roles, what is a man and what is a woman. In the Latino community the definitions of man and woman are clearly defined. The man is the provider and leader of his family. The man works and makes sure that the family has enough of the material things they need. The man clearly defines the rules of the household including the way the woman and children should behave. The woman is responsible for the home and the children’s emotional needs. The woman organizes the household responsibilities such as cooking, cleaning, budgeting where the money is absolutely necessary and making sure the house runs in the regulations laid out by the man. This may include things like dinner on the table when he gets home from work or pleasing the man’s sexual desire on his time schedule. The woman is also responsible for the emotional well being of the children. It is the woman’s duty to make sure that her children are happy, health y and not leading morally reprehensible lifestyles. The first question, what is a man, can be clearly seen in the character of Chino. Chino begins the film as a true â€Å"machismo.† He is arrogant, demanding and obsessive. He expects his wife to fulfill his very need. Chino treats Lisette like she is a possession demanding she be subservient to him.

Management Proposed by Fayol Essay

Critically examine the functions (elements or processes) of management proposed by Fayol. Explain why these functions are relevant (or otherwise) to today’s managers. The twentieth century has bought upon us a number of management theories which have helped to shape the overall view of management in the present environment of business. Many of those theories have stood the test of time and are still often referred to in the management world of today. One of the most famous theories referred to in management is that of Henri Fayol. Henri, a French engineer became somewhat of a hero for resurrecting a troubled mining company in which he worked, and turning it into one of France’s most successful businesses (Daft 2003). Born in 1841 and dying in 1925, Fayol spent most of his working life as a manager, where he drew upon personal experiences to facilitate in the creation of his theory of administration. In his most significant work, General and Industrial Management, Fayol discussed and identified five basic functions of management, which he believed every manager needed to perform. These were: planning, organising, commanding, coordinating, and controlling. These functions, although have been condescended down to four; planning, organising, leading and controlling, still underline much of the general approach to today’s management (Draft 2003). Although, the usefulness of Henri Fayol’s classical functions have come under question about their relevance in current managerial activities by a number of professionals, Fayol’s functions still continue to shape and have underlining influence on the basis in which managers perform in the business world of today. Planning If you have no particular destination in mind, it does not matter what road you take. However if you have somewhere in particular you want to go, then you have to plan the best way you can to get there (Robbins et al.2008). This phrase demonstrates the shear importance that planning has in managerial roles to an organisation. As organisations exist to achieve purpose, someone must clearly define that purpose and what is needed in order to reach achievement. That someone is management. Planning is the process in which managers use to identify and select appropriate goals and courses of action (Waddell et al. 2009). Without the definition of goals, the establishment of strategies to be used in order to achieve, and the development of plans that will be used to integrate activities, then an organisation simply will not continue to exist. Managers, therefore today must be aware of the many circumstances that surround the organisation. For instance their environment, whether it is the general environment, the task or even internal, managers must be aware of the effects these areas could have on the organisation not only in the present but also for the future. With suitable planning and strategies put in place, managers can help the organisation avoid such extremes as bankruptcy, with strong planning efforts regarding direction and demographic trends, growth and acquisitions. Therefore the first function of planning, proposed by Fayol to any organisation is not only relevant to the world in which business operates today, but also the potential to add huge value to the current and future aspects of that organisation. Organising Managers today are responsible for arranging and structuring work to accomplish the organisation’s goals (Robbins et al. 2008). Typically following planning, organising is the process managers use to establish a structure of working relationships that allow organisational members to interact and cooperate to achieve organisational goals (Waddell et al. 2009). Today’s managers determine the tasks that need to be done, who is to do them, how the tasks are to be grouped, who reports to whom and what level decisions are to be made (Robbins et al. 2008). The relevance of organising to mangers today is to create structure, which is organised with all the necessary resources. With structure, managers give employees appointed tasks, lines of authority and decision responsibility. This in turn provides employees with a sense of ownership and control over their jobs and thus strengthens initiative from them (Yoo, lemak, Choi 2006), helping to create an organisation that achieves goals. Coordinating Fayol’s management concept of coordinating sees managers encouraging direct personnel activity. Coordinating is the laying out of timing and sequencing of activities and harmonizing them all (Fells 2000). Mangers that are able to maintain the balance between the activities of the organisation, are able to succeed in creating an organisation that can come together to face problems of common interest that can surround different areas of the organisation, for instance, the many departments. The value of this concept is high, as managers from different areas within the organisation can band together and communicate as well as forecast possible problems, while offering short or long term solutions. Commanding As the word commanding suggests, managers must take authority and put the desired plan into action (Fells 200). The value of commanding in managerial roles today is important and has relevance as managers verify whether everything occurs in conformity with the plan adopted, the instructions issue and principles established (Lamond 2004) that have been previously set. Controlling After the goals have been set and plans are formulated, the structural arrangements determined, people are motivated, there has to be some evaluation of whether things are going to plan (Robbins et al. 2008) Controlling, is the function of managers evaluating how well an organisation is achieving its goals and taking action to maintain or improve performance (Waddell et al. 2009). This function is an important concept in organisational management as it demonstrates the successfulness of the organisation in terms of the achievement of goals that have been put in place by the managers. The value of controlling is extremely important, as managers are able to monitor what needs to be improved by comparing the information to performance standards and taking corrective action where necessary. Managers must ensure that the organisation is moving towards its goal and performance does not deviate from standards. Without control from managers organisational goals are not monitored and therefor e many not be accomplished affecting the overall performance of the organisation as a whole, making control very relevant to the managerial positions in business today. In conclusion, Henri Fayol’s principles of management provide and continue to provide a general management perspective for practicing managers today and an instructional tool for academics teaching in the field of management (Yoo, lemak Choi 2006). Fayol has provided a general framework for practising managers (Yoo, Lemak, Choi 2006), by which the functions of planning, organising, coordinating, commanding and controlling have a bearing connection with the practicing of managers in any managerial position across a vast number of organisations, no matter the size or level. Therefore making Fayol’s principles an essential for building strong teams and stronger organisations in today’s Business environment. Importance of Listening

Listening is part of communication and language arts. There are fights and miscommunications because nobody has the time to listen. This is a very important tool to avoid misconceptions and misunderstanding. Careful listening gives individual good and accurate information. Every individual should develop their listening skills. Until the 1940’s, no one seems to have thought that skillful listening required any particular training. Two causes have produced a changed attitude toward listening. First, there has been enormous expansion in the means of transmitting the spoken voice: by disc record, tape recording, radio, television, sound motion pictures, and videotapes. Second, there has been increased interest in group discussion, as shown partly by the conferences, conventions, and workshops that are held, and by the many discussion programs on the air. The language system encompasses the language of listening, speaking, reading, and writing. The acquisition of these skills follows a general sequence of development: (1) listening, (2) speaking, (3) reading, and (4) writing. The different language forms have a core language system that underlies and integrates the four elements of language. Experiences with each language form strengthen the underlying language system, which in turn influences an individual’s facility in each language form. Numerous situations in everyday living require skillful listening. For example, informal conversation, social and business telephoning; interviews; taking part in conferences; listening to speeches, lectures, readings, reports, and plays; and following oral directions. From the young child, who gains much of his or her knowledge from speech activities in the classroom, to the courtroom lawyer, whose success depends largely on understanding what is said, the art of listening is a language skill vital to each person’s life and work. Good listening enlarges the listener’s command of language. Through listening to speeches, poetry, and plays, a person can gain an appreciation of literature and of the spoken language. Through reading and listening have similar problems, listeners face two special conditions. First, they must grasp the meaning at once; there is no opportunity to reflect on what was said or to go back and review it. Second, listeners are directly affected by the personality of the speaker, whose voice, gestures, and presence are often as important as the words being spoken. Thus, there are good reasons for training people to listen effectively. To be most effective, listening must meet four requirements. Listening must be focused; listeners cannot be half-hearted in their attention. 2. Listening must be exact; listeners must grasp precisely what has been said, not some vague notion of it. They must be able to take hold of the content, including the sequence of parts and their relationship to the whole. 3. Listening must be aware. Listeners must be critics as well as receivers; they must be able to distinguish the essential from the nonessential; they must be as objective as possible, alert for bias in themselves as well as in the speaker. 4.Listening must be courteous; listener owes the speaker respect and interest. In education, listening is an element of the language system that has been neglected by educators. Although concern for the instruction of speaking and reading, is common, the student’s ability to listen has been taken for granted. Students are typically expected to acquire this ability without special instructions. The fact is, however, that many students   do not acquire functional skills in listening by themselves. According to medical hearing specialists, over half the people referred to them for suspected deafness have no defect in hearing acuity and no organic pathology that would cause their seeming hearing impairment. Listening is a basic skill that can be improved through teaching and practice. Compared with the quantity of research in reading, research in listening is minuscule. One explanation for poor listening skills is that students and people today are so bombarded with constant sound that may have actually learned to â€Å"tune out† what they do not wish to hear, and they have become skillful at not listening.

Eshghi, Roy and Ganguli (2008) suggested that relational quality, competitiveness, reliability, reputation and transmission quality are significant predictors of customer satisfaction. Aydin and Ozer(2005) defined it as customers overall (dis)satisfaction with the brand based on all encounters and experiences with that particular brand. Hence, in the study overall customer satisfaction with the service provider was evaluated instead of consumers specific transaction experiences. They also suggested that increased customer satisfaction, increased trust in the firm and switching costs are essential for customer loyalty. Customer loyalty is a relationship between relative attitude towards on entity and repeat patronage behavior (Dick and Basu, 1994. Oliver (1999) suggested that customer satisfaction and Customer Loyalty are linked inextricably. Harris and Goode (2004) suggested the satisfactions mediating role in the relation between perceived quality or value and loyalty. Anti n, Camarero, and Carrero (2007) have confirmed that the mediating effect of customer satisfaction between the predisposing (poor service quality and low firm commitment) and precipitating factors (price unfairness and anger incidents) of dissolution and the consumers switching intention. Also, Spiros P. Gounaris, Nektarios A. Tzempelikos, Kalliopi Chatzipanagiotou (2007) explained how customer percieved value influences, through customer satisfaction and loyalty, the buying behaviour of consumers. In our study, the term perceived price is to mean the degree of reasonability which a customer associates a given price fixed for the usage of the mobile service, value- added services charges and the monthly rental charges. This is mainly a perception factor in the consumer mind. We test for the influence of this factor, the perceived price on the construct of customer satisfaction. Customer satisfaction in turn encompasses the comprehensive view of the mobile service provider in the customer`s mind. While customer satisfaction is contingent on several factors, herein we explore the effect of the perceived price on the same. There has been a body of research carried out in the past, in various sectors, on the influence of this factor on the overall customer satisfaction levels. Carmen Anti n, Carmen Camarero, and Mirtha Carrero (2007) found evidence in the insurance industry that unfair pricing is a determinant to customer satisfaction. In fact, they have concluded that unfair pricing strongly impacts switching, in a direct and indirect manner via customer satisfaction. Chada and Deepa Kapoor (2009) have stated that Customer satisfaction in turn affects the price senility of a customer. Evangelia Blery, Nick Batistatos et al (2008) conclude that the perceived price is negatively affects a repeat purchase of a customer in a negative manner. Makam S Balaji (2009) examined the effects ofvarious factors, including perceived price on customer satisfaction in the Indian mobile telephony sphere and found it to be strongly associated. The findings of Muhammad Mohsin Butt and Ernest Cyril de Run(2008) show that the satisfaction levels of Pakistani mobile telephone service users satisfaction is dependent on price, among several other factors. Ristola and M. Kesti(2006) conceptualized that the service quality depends upon the above mentioned factors. The physical factors involves the physical product and supports, interactive quality refers to the interaction between the customer and the service provider, and the corporate quality is symbolic in nature and involves the perception about the company in the minds of the customers and its brand image. Service quality is defined as a global assessment that is the customers overall impression of the relative inferiority/superiority of the service provider and its services. Further, Rusk and Zahorik supported the expectation-perception gap for measuring service quality. The main antecedents to perceived service quality are the customer expectation and perceived performance (Bitner and Hubert). Further, Richard Spreng, Linda Shi,Thomas Page suggested that net Customer Satisfaction has a marginally higher impact on switching intention than total perceived service quality. Also, A. Taylor,Thomas L. Baker(1994) concluded that Consumer satisfaction moderates the relationship between the quality of service and intention to switch. Zhilin Yang, Robin T. Peterson (2004) found that switching costs moderate the relationship between satisfaction and perceived value. Next, Hsin-Hui (Sunny) Hu, Jay Kandampully and Thanika Devi Juwaheer(2009) examined the association and impact of customer satisfaction and perceived value and found that customer satisfaction is affected by perceived service quality. Das, Bhagaban Mohanty, Sangeeta(2007) carried out a study in the Indian context and found that better perceived service quality leads to increased customer satisfaction. Customer satisfaction results from the comparison of expected performance with that of the perceived actual performance (Churchill, Suprenant, 1982). Parasuram et al also suggested that service quality is positively related to the customer satisfaction levels and that service quality perceptions are dependent not only on the outcomes but also on the evaluation of the service delivery process by the customers. Venetis and Ghauri (2000) viewed that the service quality is regarded as one of the few means for service differentiation and competitive advantage that attracts new customers and contributes to the market share. Further, Rakshit Negi (2009) concludes that the service quality was found to be significantly linked with the overall cellular phone user satisfaction. Also, Birgit Leisen(2006) suggests, as perceived levels of satisfaction increase, the less likely the customer is going to switch to a more conveniently located competitor and, hence, the more loyal he or she remains. Further, T. Vanniarajan, P. Gurunathan (2009) concluded that the cellular operators need to engage in improving the quality of both the value added services and the main service quality to increase their customer satisfaction which would lead to a greater customer loyalty. Islam Essays - Nation Of Islam, Antisemitism In The United States Islam The UnIslamic Nation of Islam The mention of the Nation of Islam will undoubtedly cause an immense number of responses in any situation. To some, this organization symbolizes blatant racism. To others, it is seen as a savior of the black community. Regardless of ones opinion of the Nation, though, the differences between Al-Islam(traditional Islam) and the beliefs of the Nation cannot be denied. The Nation of Islam is a social movement. This social movement is undoubtedly rooted in religion, and its principles are derived from those of traditional Islam, but their basic philosophies are so strikingly different that the Nation of Islam cannot be considered Islamic. In 1930, the Nation was founded by an African immigrant who called himself Wallace D. Fard Muhammad. He stated that his mission was to take the black nation to the full range of the black mans possibilities in aworld temporarily dominated by the blue-eyed devils(forerunner.com/foreruner/X0065_Nation_of_Islam.html). This philosphy was carried on to the next leader of the Nation, Elijah Muhammad, and eventually to the current leader, Louis Farrakhan. The Nation was founded as a black organization, and has remained as such. Islam, on the other hand, is all encompassing. The first, and most astonishing, difference between the Nation and traditional Islam is the role of race in the churchs philosophy. the Nations philosophy clearly states that, We believe that intermarriage and race mixing should be prohibitted (www.noi.org/ program.html). The traditional wording of the Koran, however, states that diversity in race is one of Allahs greatest creations(Koran, 30.22). The Nation of Islam restricts its membersip to those who are black. the beliefs of traditional Islam, however, state that all persons are born Muslim, and that every person is endowed by Allah with the spiritual potential and intellectual inclination that can make him a good Muslim.(4) The Islamic church ignores the issue of race when examining ones spiritual purity. Rather, It is the spirit itself which defines a Muslim. Traditional Muslims and members of the Nation of Islam also differ in their definition of what it means to be Muslim. The belief in Islam is defined by five Pillars: shahada(the belief in only one Allah), salah(prayer), zakuh(obligatory charity), sawm(fasting), and hajj(pilgrimage) (www_leland.stanford.edu/group/Thinker/v2/v2n3/Saudi.html). Of these Five Pillars, the Nation of Islam requires none of its members. The shahada is rejected by the Nation because it belives that Wallace D. Fard Muhammad was Allah incarate. (noi.index) Salah, or the five daily prayers in the direction of Mecca, are also not required of members of the Nation(coolguy). Zakuh is rejected by the nation, as it believes charity is a way to benefit the dominant classes of the culture.(coolguy). Sawm is also not required of Nation members, nor is the hajj to Mecca(coolguy). (Ironically, it was the hajj of Malcolm X which led him to abandon his separatist beliefs, and to preach unity). The rejection of the five basic requirements of Islam is representative of the distances between the Nation of Islam and traditional Islam. Because of these differences, the Nation cannot be accepted as just another chapter of Islam, but it must be treated as a different and distinct religion. The third difference between the Nation of Islam and traditional Islam is the manner in which other religions and their members are regarded. Islam accepts the existence of all prophets from Moses to Muhammad. (Koran, 2:91) The Nation, however, believes that Wallace D. Fard Muhammad is the true prophet(Noi.program). Traditional Islam regards members of all religions as holy. The Koran states that, those who believe, and those who are Jews, and Christians, and Sabaeans-whoever believeth in Allah, and the Last Day doeth right- surely their reward is with their Lord, and their shall no fear come upon them neither shall they grieve(2:62). Farrakhan, on the other hand condemns those of other religions and races. In a speech in January 1994, Farrakhan warned members of the Nation of Islam that they(the jews) are plotting against us even as we speak (www.strang.com/cm/stories/emmy/96tl.html). He proposes that other religions are inferior to Islam, as well as proposing that different races are unequal. The Nation of Islam believes that the white race was created by a botched experiment of mad scientist named Yakub, 6,000 years ago(7). It is beliefs such as this which create the image of the Nation which is common to most: a racist organization which preaches Black supremacy. Mayan Civilization City of Copan, Honduras

Mayan Civilization City of Copan, Honduras Copn, called Xukpi by its residents, rises out of the mist of western Honduras, in a pocket of alluvial soil amid rugged topography. It is arguably one of the most important royal sites of the Maya civilization. Occupied between AD 400 and 800, Copn covers over 50 acres of temples, altars, stelae, ball courts, several plazas and the magnificent Hieroglyphic Stairway. The culture of Copn was rich in written documentation, today including detailed sculptural inscriptions, which is very rare in precolumbian sites. Sadly, many of the booksand there were books written by the Maya, called codiceswere destroyed by the priests of the Spanish invasion. Explorers of Copn The reason we know so much of the inhabitants of the site of Copn is the result of five hundred years of exploration and study, beginning with Diego Garcà ­a de Palacio who visited the site in 1576. During the late 1830s, John Lloyd Stephens and Frederick Catherwood explored Copn, and their descriptions, and particularly Catherwoods illustrations, are still used today to better study the ruins. Stephens was a 30-year-old attorney and politician when a doctor suggested he take some time off to rest his voice from speech making. He made good use of his vacation, touring around the globe and writing books about his travels. One of his books, Incidents of Travel in Yucatan, was published in 1843 with detailed drawings of the ruins at Copn, made by Catherwood with a camera lucida. These drawings captured the imaginations of scholars the world over; in the 1880s, Alfred Maudslay started the first excavations there, funded by Harvards Peabody Museum. Since that time, many of the best archaeologists of our time have worked at Copn, including Sylvanus Morley, Gordon Willey, William Sanders and David Webster, William and Barbara Fash, and many others. Translating Copan Work by Linda Schele and others has concentrated on translating the written language, which efforts have resulted in the recreation of the dynastic history of the site. Sixteen rulers ran Copn between 426 and 820 AD. Probably the most well-known of the rulers at Copn was 18 Rabbit, the 13th ruler, under whom Copn reached its height. While the level of control held by the rulers of Copn over the surrounding regions is debated among Mayanists, there can be no doubt that the people were aware of the populations at Teotihuacan, over 1,200 kilometers away. Trade items found at the site include jade, marine shell, pottery, sting-ray spines and some small amounts of gold, brought from as far away as Costa Rica or perhaps even Colombia. Obsidian from Ixtepeque quarries in eastern Guatemala is abundant; and some argument has been made for the importance of Copn as a result of its location, on the far eastern frontier of Maya society. Daily Life at Copan Like all of the Maya, the people of Copn were agriculturalists, growing seed crops such as beans and corn, and root crops such as manioc and xanthosoma. Maya villages consisted of multiple buildings around a common plaza, and in the early centuries of the Maya civilizations these villages were self-supporting with a relatively high standard of living. Some researchers argue that the addition of the elite class, as at Copn, resulted in the impoverishment of the commoners. Copn and the Maya Collapse Much has been made of the so-called Maya collapse, which occurred in the 9th century AD and resulted in the abandonment of the big central cities like Copn. But, recent research has shown that as Copn was being depopulated, sites in the Puuc Region such as Uxmal and Labina, as well as Chichen Itza were gaining population. David Webster argues that the collapse was merely a collapse of the ruling elites, probably as a reuslt of internal conflict, and that only the elite residences were abandoned, and not the entire city. Good, intensive archaeological work continues at Copn, and as a result, we have a rich history of the people and their times. As for other parents they might want their children to read this book. I dont see how this women really sees herself as Bakersfields "parental figure" and takes it among herself to say what other peoples children may read. Personally I feel as if she thinks me and my peers too stupid to understand the meaning of the book, and not mature enough to seperate the reality of those 11 "pornographic" lines. Sex, incest, and rape are all things that are real and happen in our world. Many children are exposed to these unpleasant realities. I believe that this women is out of touch with her daughter if she thinks that her daughter does nott know what these things are. I am very insulted at the fact that she thinks it her job to take on the responsibility to choose what I can not read. I have two parents already that make fine descisions for me, I don't really need another one. Those 11 lines are said to be pornographic and probably are when taking out of text. Those 11 lines are merely particles of the total piece of literature. I have not yet read "The Bluest Eye," but plan to. This book is said to be very eduactional and a great piece of literature. Should students really be banned from reading this book because of 11 lines? If any parent does not want to have their child read a book they have every right to not let them, but this women should have no say over any one elses child except her own. Also I think it very ridiculous of her to carry this on any further than it has already gone.

National History Day Process Paper

The topic my partner and I have based the National History Day Project on is the Mayan Calender system compared to the Hopi Indian Tribe system. The reason I liked this topic is because it is currently 2012 and so the the world ending is a huge controversy in society. I am very interested in the subject and wished to do deeper research on the predictions by not only the Ancient Civilization of the Mayans. I have recently discovered the Maya people are not the only people with these beliefs and so I have grown more fascinated.The idea of basing our project on this topic was actually the first thing to cross my mind when we were informed of the project, so we decided it fit with everything this year. The research for this particular topic is very difficult because of the fact that the Mayans are such an ancient civilization so have very few primary sources. This is the main reason for including the more recent civilization of the Hopi Indian Tribe. I conducted my part of the research u sing the ABC Clio Database and other websites in which I was recommended.It is definitely not easy to conduct this research which requires a lot of patience, smart searching and reliability. We managed to find perfect information to allow us to shine the theme across the topic. The presentation category we have chosen to use is the exhibit. The reason I wanted to use this category is because my partner and I do not work best with technology and are able to better portray information in a more old-fashioned matter. I believe this is the most efficient way to get our research across. We have felt very confident with our project from the beginning.We are using a mid-sized poster board. Our creativeness works well with our topic and our research is sweet, short and to the point. Our project relates to the NHD theme of Revolution, Reform and Reaction because the ideas of the Hopi Indians coincides with those of the Mayans. This part relates to the Revolution portion of the theme. The top ic relates to the reform section because it has been edited and is used today. The reaction part is how the people have reacted to the end of this system and the predictions made according to their astrological beliefs.

Martha Stewart

Martha Stewart a known celebrity and founder of Martha Stewart Living Omnimedia (a business which is built on showing others how to cost effectively manage and decorate the home), who was given a tip by Douglas Fanueil and Mr. Bacanovic, employees of the Merrill Lynch brokerage company. This tip which broke the confidentiality policy of the brokerage company led to the subsequent sale of Martha’s shares in the ImClone company during the latter company’s blackout period with the effects of causing the share price of ImClone’s share to drop and the share price of shares of the Martha Stewart Living Omnimedia to drop after the scandal broke that Martha had engaged in insider trading. Through a series of events, she, her broker and his assistant were subsequently prosecuted and sentenced. In this case study, we will be examining how the public perceived Martha Stewart’s actions and also the penalties that were imposed. We will also look at how her decisions impacted and also provided major setbacks to her business because of her insider trading scandal on the Imclone Systems Incorporated. By carrying out this research, we as a group would determine if the blame should be placed on her or not and also determine if the fines were adequate for the crime committed. 1.Did Martha Stewart commit the crime of insider trading when she sold her ImClone shares on December 27, 2001? We believe that Martha Stewart was guilty of insider trading. The justifications for our point are as follows: a) Martha Stewart was told by Mr. Faneuil (under direction from his boss who was also Ms. Stewart’s stockbroker) that the largest stockholders of ImClone (Sam Waksal and his daughter Aliza) had sold all their shares in the company on that same day, December 27th, and she immediately sold hers as well. This in itself was a breach of client confidentiality and insider information because no one knew about it but their stockbrokers. By virtue of the position Mr. Bacanovic (Mr. Faneuil’s boss) at the brokerage company of Merril Lynch he was not to mention or discuss the actions of any of his other clients. b) Even though Martha Stewart did not know about the FDA’s unfavourable report about ImClone, the sudden ‘dumping’ of the shares on the market was enough for her to speculate that there must be something wrong and that she should get her shares sold as quickly as possible in order to obtain the best possible share price or avoid a loss. Tipped with the knowledge of the Waksals actions and her intuition of imminent disaster she ordered that her shares in that company be sold as quickly as possible. c) She called Sam Waksal as soon as she received the tip-off in the hopes of obtaining the reason behind their actions. d) When investigated by criminal authorities she instructed her secretary to change the original message the secretary wrote from Mr. Bacanovic and then thought better of it and advised the secretary to revise the changes and restore the original message. She also lied repeatedly to criminal authorities on the real reason behind the sudden sale of her shares. 2.Did the U.S. Attorneys and the Securities and Exchange Commission use good judgment in the indictment of Martha Stewart? Do you believe that her indictment was based on evidence of a serious crime, or do you believe that prosecutors consciously or unconsciously had additional motives for pursuing the case? It is our belief that good judgment was exercised in indicting Martha Stewart. The indictment was based on the evidence of reasonable intent. Martha Stewart on hearing of the actions of the Waksals, and making reasonable judgments that the company was in trouble, intended that she should not make a loss on her investment in ImClone and made immediate moves and succeeded in selling her shares in the company for a profit of $228,000. If she had waited until December 28th when the share price fell to $45.39 per share she would have made only $178, 292, a loss of $49,708. Also the trading of Martha Stewart’s shares occurred during the company’s blackout period which commenced on December 21st. At this time no shares from the company were permitted to occur and the stockbrokers at Merrill Lynch would have known that and should have advised their clients accordingly. It is our belief that prosecutors might consciously have had additional motives for pursuing the case. Martha Stewart a celebrity of high profile would sell newspapers if investigated and later indicted. A prosecutor who was able to make a strong, believable case would bring fame to himself/herself and possibly new job opportunities. 3. Do you agree with the jury that she was guilty beyond a reasonable doubt of the conspiracy and obstruction of justice charges? We agree with the jury that Martha Stewart was guilty beyond a reasonable doubt of the conspiracy and obstruction of justice charges. To establish a reasonable doubt of conspiracy, four main things must occur: a) Two or more persons in some way or manner, coming to a mutual understanding, in trying to accomplish a common and unlawful plan as charged in the indictment. An example of this includes the breakfast meeting between Martha Stewart and Peter Bacanovic on January 16th – after the sale of the shares – to construct a statement that they reproduced to the criminal authorities – that is, that Martha had agreed to sell her shares if the share price fell below $60.00 per share. Another example was illustrated when Douglas Faneuil was persuaded by his boss (Peter Bacanovic) to agree to the conspiracy constructed by his boss that there was a $60 stop-loss order on Martha Stewart’s ImClone shares. b) The person willfully became a member of such a conspiracy. Mr. Fanueil accepted a bribe from his boss (Peter Bacanovic) in the form of an extra week of vacation and a paid trip, so that he would not reveal the fact that Martha Stewart had been tipped off. Fanueil’s actions were acts of choice. c) That one of the conspirators during the existence of the conspiracy knowingly committed at least one of the methods (or overt act) described in the indictment. Bacanovic and Stewart repeatedly lied to the government agencies and attorneys in order to try to hamper the investigations. Bacanovic tampered the worksheet by adding â€Å"@60† near the entry for Stewart’s shares of Imclone. d) That such ‘overt act’ was a knowingly committed act done in order to carry out or accomplish some object of the conspiracy. Justification of this was seen when Bacanovic informed Faneuil that he must call Stewart to inform her of the Waksal’s actions. He decided to leave the message with Stewart’s administrative assistant in order for her to receive the message to allow her to carry out or give instructions on what actions to take. Faneuil had asked Bacanovic if he was allowed to tell Stewart and he stated â€Å"Of course that’s the whole point† On realizing what the written policy inside of the office stated he was very worried. Obstruction of justice is a crime. It is an offense that arises when someone tries to prevent, impede or influence the administration of justice, for example, bribing a juror, threatening a judge or encouraging false testimony. Obstruction of justice occurred when Stewart and Mr. Bacanovic conspired and continuously lied about the reason why Stewart sold her shares in an effort to hamper investigations. One such lie was the prearranged plan to sell Stewart’s shares if the price fell below $60 per share. 4. Was her punishment, including both imprisonment and fines appropriate? Were the punishment of Peter Bacanovic and Douglas Faneuil appropriate? We agree that the punishment imposed on Martha Stewart was a little too lenient. Due to her actions after being tipped off, she was able to make a profit of approximately $50,000, thus a fine of $30,000 still meant that she was gaining approximately $20,000. We believe that all of her profits should have been disgorged as compared to her wealth the amount is relatively small anyway. The imprisonment of five months imprisonment and then five months of home confinement, we believe was a suitable length of time. The relinquishing of her duties to act as an officer of a public company did not do her any damage as she still drew the same salary as she was accustomed to and even had a bonus. In her after-sentencing statement, she said that this had been no more than a personal matter that had been blown out of proportion; this in itself indicates that she was not remorseful about her actions. Whether these punishments were a deterrent for future action is questionable as Martha Stewart still violated the terms of her house arrest and this had to be subsequently extended for three weeks. We think that the punishments imposed on both Peter Bacanovic and Douglas Faneuil were inappropriate. First we look at Douglas Faneuil. Although he was following the instructions of his boss, he knew what he was told to do was wrong. He knew there was a displayed, written office policy with respect to client information privacy. He accepted a bribe from Mr. Bacanovic and waited approximately seven months after the incident before coming forward with the truth. A short term of imprisonment at a minimum security facility might have been added. With respect to Mr. Bacanovic, his penalties should have been harsher. His position at Merrill Lynch afforded him access to certain non-public information and as such his actions should have been within the law. He disregarded the policies of the company with respect to confidentiality, he also used his position to influence and bribe another employee of the company to comply with a conspiracy in the commitment of insider trading and he also conspired with his client Martha, to concoct an alibi to avoid prosecution by the government. He should have been given a heavier fine since he was the main person behind the scandal and had gained commission on the sale of both the Waksal and the Stewart shares. Also a longer term of imprisonment would have been fitting, maybe a term of two years.

When children feel emotionally safe and secure, they are able to explore and find out about the place where they are and the things they can see, touch, manipulate or maneuver. Children develop and learn in the environment where their individual needs are expressed, as well as the relationships between the employees and them are positive. Positive environment helps a child to become independent and gain confidence in learning new skills and also achieve a sense of dependency. Environment is characterized by three aspects. Its emotional environment, outdoor environment and indoor environment. These three aspects are the context for games and learning. The emotional environment is more than a physical space. This is because children share emotions as well as parents and members of staff. The emotional environment is an invisible tool to assess feelings. Sometimes it can be a feel-good factor when all the people in that environment feels good. And for others it may not pose such a positive feelings in an environment where people don`t feel happy. It is important to maintain positive feelings and tightened feel safe emotional environment, because if children feel safe and equally, they can express feelings in a safe knowledge and they know that their employees or parents are near and ready to help. The ways to teach children in which they speak and express feelings, allowing them visually express it safely, rather than hold tight it to yourself and leave it a s a secret. It is important to express feelings safely and it can be easier resolved than those who remain unresolved. Lets talk about outdoor and indoor environments. So generous indoor environment has a direct impact on childrens learning and development quality. Comfortable, interesting and attractive interior environment which is suitable for use by children is known as a rich environment. This is the environment which becomes a second home for a child. There they sleep, play, eat or spend time by doing something else. Suitable environment is slightly different from the childs age. For example, for a group ofchildren under two years old, is three and a half square meters of space per child required and from two to three-year-old c hild needs just two and a half square meters of space required. But I will discuss it more detailed a bit later. Most importantly, the environment where children feel happy and secure. Inside area must be carefully planned in order to accommodate a flexible and changing for child`s needs and interests. Resources should be of the highest quality. Such as drawing tools, t oys or books. A significant benefit is learning outdoor. Ideal conditions, when the children have the opportunity to be outdoors every day, except when weather conditions are not favorable enough. Well, while they are out children are free to move, to breathe clean and fresh air and use all senses like sounds, colors, spaces and a sense of scale. The trust being outside is growing and by support children have the opportunity to play wide, to explain the problems and develop creativity with other children. Physical activity in outdoor environment is enhanced. Well, and the resources do not need to be expensive. This can be logs, boxes, old tires or anything else that encourages imagination and creativity using these resources in different ways. A good idea would be to establish a place of nature in where trees grow or can be ability to plant flowers. This creates greater contact with the natural world. Outdoor environment supports active learning. When this is combined with a peacefu l place for reflection, it can really improve the lives of children. Lets move on to the next important issue. This is a safe but challenging environment. What is it and what it brings to children? I will discuss the factors you need to consider when planning a safe but challenging environment. The meaning is that the child must be safe, but has a challenging environment. Because it increases the life skills which has a positive impact on all aspects of development. Creating an environment child increases self-confidence and allows him / her to see the deeper perspectives of life decisions. It is vitally important to have a safe environment in preventing incidents and reducing the risk. Parents do not need to worry about any hazard but feel calm. Each activity involves certain risks and the likelihood of children must learn how to deal with it. They need to see and survive, suffer the consequences, when absent careful. It is important to teach children to accept personal risk assessment and think about the possible consequences of their actions. Adult s should teach children safely use the equipment. It is important to protect children from harm and danger conscious when allowed to develop independently. We are surrounded by hazards and risk, so we need to evaluate risk. The environment risk in the setting is minimal, but it is important to know. What is the difference between risk and hazard is easy to understand. This is a concept which is the relationship between. So, there is a potential risk of injury causes and risk of injury is more likely. If all other factors are equal, in particular position of people and entities to, then the risk is proportional to the degree of risk. Nevertheless, all other factors are very rarely equal. The risk of doing something that has a chance of bad development. A hazard is something that is a bad influence on the development. As we see the difference between these two concepts are not big because they influence each other. This means that the chance to influence the risk of an event or a caus e is 50:50. The danger is that what influences incident such as liquid spills on the floor. It is very important for risk assessment. This work, which has a potential to cause injury to people needs careful observation. There are five basic steps that will help to assess the hazards in the work environment. The first thing to identify, characterize, and then find out how to deal with who can be injured. The third step is to remove risk precautionary decision. Fourth step and record the findings of their realization and evaluation and finally review and update if necessary. I will tell an example of how to manage the risk assessment. So, there are people who are reported to risk assessments. This can be a room leader. Hazards such as subsidence due to the mess is resolved simply by removing toys from the floor, when not in use. This staff member has to provide a positive environment for all childrens needs including physical, language, emotional and social. Environment must take individual needs of the child, stimulate, provide opportunities for any type of games and activities. It must also meet the positive social interaction and physical development. When the children are older, the practitioner can help children understand how they can protect themselves, how to comply with the safety requirements, and what they do. I will speak more about this a little bit later. The emotional environment provides an ability for children to express their feelings, they are more likely to explore the knowledge and feel safe. So practitioner should encourage a child ren to express their feelings and allow them to talk and develop active listening skills. A practitioner has a very important role on daily activities. There are other people who are great assistance. Including General manager, health visitor, a pediatrician, social workers, dentists, psychotherapists, speech and language therapist, emergency service and other agencies, such as Ofsted. A brief description of the main responsibilities of a teacher or a health visitor is that those people managers you. Health and safety officer monitors and provides procedures for records and reports. Local manager makes decitions on the removal of barriers of health and safety. And as I said all employees report any information relating to health and safety. Well, on health and safety issues employees have many duties and responsibilities. An employee takes care of the safety of children while they are playing, also draws attention to the room lighting, furniture, security, hot seasons arrange for th e safety of children, such as put suncream when children go outside, advised to wear hats and so. Also, as I mentioned earlier worker prepares records, evaluate safety. Potential hazards to health, safety and protection of the work environment is diverse, including lighting, temperature, tired rooms, ventilation, toleto premises and the like. Then the employee starts work he / she must be informed about health, safety and security procedures. He / she must report about their individual needs, desires, preferences and choices. This is in order to ensure safety. It is important to act in accordance with the role and limits the personal liability of relations to solve health and safety issues when necessary. No less important aspect is the report on health and safety issues and let the right people to complete the safety and health records according to legal and organizational requirements. Risk reduction and work with others is necessary in order to minimize the risk of potential risk s in the setting. The employee must ensure that their personal health and hygiene is not a threat to others. As I mentioned, all suppliers are required to perform the requirements of space environment, as well as the proportion of workers. Next one is Control of Substances Hazardous to Health Regulations ( COSHH) and these regulations require employers to assess and prevent the risks to health from use of any haz ardous substances used in workplace. So obligations to employers are to assess the risks, decide what precautions are needed, ensure that control measures are utilised and maintained, monitor exposure, etc. and the other regulations which are designed to bring the United Kingdom into line with European laws are The Healt and Safety (First Aid) Regulations 1981, Reporting of Injuries, Disease and Dangerous Occurences Regulations 1995 (RIDDOR), Fire Precaution (Workplace) Regulations 1997 and The Food Handling Regulations 1995. Security controlled actions must be such as: supervised who have a right to be in that environment, used to validate the methods and procedures when there is a risk of potentially promising activity, including the correct movement and storage techniques wearing the appropriate personal protective equipment. It is important to take appropriate and immediate action. Such as the use and storage of equipment and materials, when you want to deal with such things as spills or debris dispositive. These examples require hygiene. Finally, it would be a good idea to include grandparents, aunts, uncles and other relatives. It shows respect for the individual needs of children and families and combines their characteristics and communication with members. This will also helps to feel at home as well as allowing to settle and explore. The wider community also plays an important role in childrens learning and development. When a child is determined by what he / she needs to, other professionals are vital to their care, training and development, and they are ready work with other professionals.
